1. Acceptance of Terms

By accessing or using DOD Crash Pads ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

2. Description of Service

DOD Crash Pads is a platform that connects military members seeking temporary housing (TDY accommodations) with property managers who offer crash pad rentals. We facilitate communication and discovery but do not directly provide housing or property management services.

3. User Accounts and Eligibility

3.1 Account Registration

To use certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.2 Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use this Platform. By using the Platform, you represent and warrant that you meet these requirements.

4. Terms for Renters (Military Members)

4.1 Profile Information

When creating a renter profile, you agree to provide accurate information about your TDY location, dates, training assignment, and contact details. This information will be shared with property managers when you submit inquiries.

4.2 Property Search and Inquiries

You may search for crash pads, view property details, and contact property managers through the Platform. All rental agreements, payment arrangements, and terms are established directly between you and the property manager. DOD Crash Pads is not a party to these agreements.

4.3 Renter Responsibilities

• Communicate respectfully with property managers
• Honor commitments made regarding rental dates and terms
• Respect property rules and regulations
• Provide accurate information about your TDY requirements

5. Terms for Property Managers (Crash Pad Providers)

5.1 Property Listings

As a property manager, you may create listings for your crash pad properties. You agree to:

• Provide accurate, truthful, and current information about your properties
• Upload authentic photos that represent the actual property
• Accurately describe amenities, availability, and rental terms
• Keep your listing information up to date
• Comply with all applicable housing laws and regulations

5.2 Manager Responsibilities

• Respond to inquiries in a timely and professional manner
• Honor rental agreements made with military members
• Maintain properties in safe and habitable condition
• Comply with fair housing laws and non-discrimination requirements
• Ensure all required permits and licenses are current

5.3 Non-Discrimination

Property managers must comply with federal, state, and local fair housing laws. Discrimination based on race, color, religion, sex, national origin, familial status, disability, or military status is strictly prohibited.

6. Prohibited Conduct

You agree not to:

• Provide false, misleading, or fraudulent information
• Impersonate another person or entity
• Harass, threaten, or abuse other users
• Use the Platform for any illegal purpose
• Attempt to gain unauthorized access to the Platform or other user accounts
• Scrape, harvest, or collect user data without permission
• Upload viruses, malware, or other malicious code
• Interfere with the proper functioning of the Platform

7. Content and Intellectual Property

7.1 User Content

You retain ownership of content you submit to the Platform (photos, descriptions, messages). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with operating the Platform.

7.2 Platform Content

The Platform's design, features, software, and content (excluding user-generated content) are owned by DOD Crash Pads and protected by copyright and other intellectual property laws.

8. Disclaimers and Limitation of Liability

8.1 No Warranty

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

8.2 Not a Party to Rental Agreements

DOD Crash Pads is a platform for connecting renters and property managers. We are not a party to any rental agreements, do not verify property listings, and do not guarantee the quality, safety, or legality of any properties listed.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOD CRASH PADS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY RENTAL TRANSACTIONS ARRANGED THROUGH THE PLATFORM.

9. Indemnification

You agree to indemnify and hold harmless DOD Crash Pads, its officers, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your rental agreements or property management activities

10. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. You may delete your account at any time through your account settings.

11. Modifications to Terms

We may modify these Terms at any time. Material changes will be communicated via email or Platform notification. Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
